How to Transfer to a
New Job While on an AEWV
– Insights
Starting a new job is always exciting, but if you are holding an Accredited Employer Work Visa (AEWV), changing employers or roles is not as straightforward as simply signing a new contract and showing up to work.
You might be wondering if you can start working straight away, or if you need to do something with your visa first. In most cases, you may need to apply for a Job Change with Immigration New Zealand (INZ) before changing your job position, employer and/or work location.
Understanding Your AEWV Conditions
Each AEWV is tied to specific work conditions set out in your visa approval. Failing to follow the correct process before moving roles could put your immigration status at risk.
These conditions typically include:
-
- Employer – you can only work for the accredited employer listed on your visa;
- Role – your position must match what was approved in the Job Check, and you may only work in this role;
- Location – you must work in the approved work location; and
- Pay rate – you must be paid at or above the minimum wage and within the market rate for your job. (Note: From 10 March 2025, the median wage requirement has been removed. However, current AEWV holders must continue to be paid in line with their employment agreement and visa conditions).
Working outside these conditions, even for a short period or while waiting for your new visa/job change approval, is considered a breach of your visa conditions. Serious consequences can follow including, refusal of future temporary visa applications on “bona fide” grounds, deportation liability under section 157(5)(b) of the Immigration Act 2009, and disruptions to your employment and pathway to residence.
Applying for a Job Change
If you wish to change your job, you can apply for a Job Change, provided that your new employer is accredited with INZ and has a valid Job Check approval for the role.
To apply, you will need:
-
- The Job Check approval number/token from your new employer;
- A copy of your job offer and employment agreement;
- Meet the qualifications and work requirements listed in your new employer’s Job Check application or show that you are suitably qualified through training and experience.
If you are still working out your notice period in your current role, you can explain this in a covering letter with your application so that your new visa conditions align with your intended start date.
Keep in mind that a Job Change does not extend your AEWV, as the visa expiry date remains the same.
Job Change vs New Visa Application
In some cases, applying for a new visa (whether AEWV or another type) may be a better option. For example:
-
- If your current visa length is nearing its maximum duration; or
- If you are eligible for a different type of visa, such as a partnership-based visa.
Each option has its pros and cons. The best choice depends on your personal circumstances, timelines and long-term plans in New Zealand. Always ensure you maintain lawful status and your ability to work while waiting for the outcome of any new application. If in doubt, seek professional advice so you can be given proper guidance before making a decision.
Moving Forward with Confidence
Breaching visa conditions can have serious consequences. By taking the right steps before starting a new role, you can protect your status, avoid unnecessary risks and keep your immigration journey on track. Whether through a Job Change or a new AEWV, following the correct process is essential to safeguarding your visa and your future in New Zealand.
